Job Overview
We’re hiring a Common Law Legal Drafter who will play a crucial role in the development of the International Financial Center of Cambodia (IFCC) by providing expert recommendations on common law principles and their application across a wide coverage of firm interests, including real estate, tax compliance, and financial services. The position holder will work closely with the Public Policy Team to integrate common law aspects into the IFCC’s legal framework, either through incorporation into new/ existing sub-laws or by drafting new common law codes exclusively for the IFCC.
Job Responsibilities
- Conduct targeted comparative legal analysis between common law systems and Cambodia’s civil law framework to guide policy decisions
- Assess and benchmark legal drafts against international best practices to ensure alignment
- Provide expert recommendations on applying common law principles to financial regulations within the IFCC
- Draft new prakas, regulations, and policy proposals focusing on tax incentives and initiatives for IFCC development
- Collaborate with the Public Policy Team to incorporate common law elements into the IFCC’s legal structure
- Engage with investors to address concerns regarding tax policies, business registration, and dispute resolution
- Evaluate IFCC operations for compliance with AML, CTF, and CPF standards, and recommend corrective actions as necessary
- Monitor and report on the implications of legal and regulatory developments affecting the IFCC
- Draft compliance policies and governance guidelines for the IFCC
- Collaborate with Cambodian regulatory and statutory bodies on legal matters
- Work with internal teams to integrate legal perspectives into public policy initiatives
- Coordinate with external legal counsel to draft prakas and sub-prakas supporting the IFCC
- Represent the company on international platforms, including trade shows and investor outreach events
Compulsory Qualifications
- Juris Doctor (J.D.), Master of Laws (LL.M.) in International Financial Law or equivalent from a prestigious common law jurisdiction university
- 3-7 years experience in international financial law or equivalent
- Certification in financial regulation or international business law is preferred
- Bar admission in at least one common law jurisdiction
- Proven experience in analyzing and drafting legal documents for common law jurisdictions
Technical Skills
- Proficient in drafting complex legal documents, including prakas, regulations, and compliance policies, following international best practices
- Expertise in comparative legal analysis, benchmarking legal frameworks, and integrating common law principles into civil law systems
- Strong knowledge of financial services legislation, including securities law, banking regulations, and corporate governance
- Familiarity with international compliance standards such as AML, CTF, and CPF frameworks
- Skilled in legal research, utilizing case law tools and databases to support drafting and policy development
- Understanding of tax incentives, business registration processes, and dispute resolution mechanisms within financial and regulatory contexts
- Experience in advising on cross-border financial services and regulatory harmonization
